Statute of limitation for child New Mexico medical malpractice no longer stands

A state Court of Appeals has ruled the New Mexico Medical Malpractice Act, which gives children until the age of nine to sue for negligent medical care occurring when they were six years or younger, no longer valid. Minors will have until they turn 19 to bring a New Mexico medical malpractice claim. The appellate court said a statute of limitations for children violates their due process rights.
